Settlement nears in iPod battery lawsuit

A court has conditionally approved a settlement in a class action lawsuit brought against Apple by consumers who claim their iPod batteries did not live up to Apple's claims. Under the settlement, class members who purchased or obtained a new third-generation iPod will be eligible for a one-year limited warranty extension on that iPod to cover battery failures. If the iPod experiences or has experienced battery failure during the one-year extension period, consumers who submit a valid claim have the option of returning the iPod to Apple for a replacement or receiving a $50 Apple Store credit. Class members who purchased or obtained a new first- or second-generation iPod on or before May 31st, 2004 and experienced battery failure within two years of purchase will receive a $50 credit at the Apple Store or a $25 reimbursement check.

but did someone actually come up with a REASONABLE settlement offer? No free iPods, no iBooks, no heads on platters, just the cost of a battery replacement? Wow, will wonders never cease...

I have to side against Apple on this one. I purchased a 30GB iPod, refurbed (which is supposed to mean like new), and the battery life dropped to 2.5 hours after 13months of use. Piece of Sh*t. I replaced the battery myself and life jumped to 8 hours.

I'm filing for the $50 Apple Store GC. I think I'm getting a shuffle.

ummmm, reasonable? Lemme get this straight, ipods batteries after extended use(1+) years are getting shorter battery life. Apple has battery replacement programs available on their website, as well as many vendor's online that both sell the battery, or offer to replace it for you. Anyone with 1/2 a brain knows batteries dont last infinitely, because, well, it's a battery! The chemical's break down and can't hold a charge any longer. Again, it's a battery! Why is Apple even settling?

In other news... Honda Motors Corp. is being sued because after 50,000 miles the tires are wearing down on their vehicles.

Battery going strong after all this time. Treat it right and it treats you right.

Eriamjh: You do deserve the $50. Somebody probably mis-handled the battery before you ever had the thing.

What is so exceptional about this problem? Was Apple advertising ten year battery life? Batteries slowly losing their life is a well known issue for just about any portable device that relies on one.

Gee, given precedent, think I could start a class action lawsuit against cell phone manufacturers when I am forced to buy a new phone or battery every year because the orginal no longer charges fully?

My other iPod is 18 months old and holds over 6 hours with daily use. The refurb lasted 13 months and only lasted 2.5 hours. Stop being an Apple A$$ kisser and admit that some people got screwed. Sure, Apple never advertized batery life, but I know I didn't get 500 or a thousand charges before the battery went to hell.

Because other people much more intelligent than you have determined that it is more worthwhile to settle?

I have yet to read the settlement but from one news source it is alleged that Apple claimed that the battery would last the lifetime of the device and would power uninterrupted play for up to 10 hours. Well, Apple should not have claimed it then.

Honda never claimed that the tire would last the lifetime of the car.
