iPod triggers Chinese patent infringement suit

Chinese iPod lawsuit


Apple and two affiliated companies have been sued in China for patent infringement, according to People's Daily Online. Two Beijing residents, Cai Yaohua and Chen Shaohua, are said to hold a patent for an intelligent audio server; the individuals believe that their technology is being used illegally in iPods, as well as a number of other players. The case will bring Apple, Apple Computer Trading, and Whuan COODOO before the Wuan Intermediate People's Court. The patent in question was applied for in 1996, and finally granted in 2002.

Apple has had to defend the itself against several similar claims in the past, including a suit filed by Creative in 2006 that accused the iPod-maker of knowingly infringing on a Zen patent relating to user interfaces. Another suit filed this year, on behalf of inventor Henry Milan, argued that Apple violated a connecting mechanism patent.

    In a country where patents are ignored, and Apple is being sued there? WTF? How about China starts enforcing patents and then we can start taking them seriously.

    and yet they're pointing their fingers in our direction. They copy everything from iPods to iPhones over there. I'd wish them good luck, but I really hope they lose the case.

    ...I guess thieves know no shame, particularly when the thievery is being supported by their equally thieving government.

    The outcome of this 'case' will be telling, to say the least.

    Wouldn't be surprised to find that the 'patent' as well as the original filing dates are all forgeries...

    Patent protection in China? Did I wake up in an alternate universe this morning? Is this Donny Darko 2 ?

    And, how exactly is an iPod an audio server? I'd take the time to read the patent, but honestly, I just don't care enough.

    Apple attorney: "Then you don't mind if we carbon date these patent documents, then?"

    Chinese official: "The Chinese government does not recognize the validity of the carbon dating process."

    these dirty chinese commies come here, take our jobs and do everything they can do cut costs and increase their profits. I'd say it would get better but these bleeding heart lefties are going to do nothing but pander to the "international community" when they take the white house next year.

    Davie boy, davie boy. You need to keep your mcpalin rhetoric to yourself please, this is a mac forum, not a RNC.

    The chinese patents aren't real. Chinese workers have no rights. China is a joke of a country, and even if they host an athletic competition they are nothing but a country of slaves. Apple should take all of their production to other countries, where the government isn't totally insane and workers have rights, and make products that don't develop cracks.

    This is what happens when China gets their hands on billions of Olympic dollars. They do not honor the Western Worlds Copyright laws and they try to turn the table on us. Those gymnasts are the best in the world but it borders on child abuse. Why, because it's for the good of the country and it reinforces the superiority of the race. They will make Apple spend a lot of money and it will be drug out forever and China will say it's a victory like the President of Iran has used his rants to use his power over the US. Thank you for enduring my rant and I will leave you with this thought, politics are not an honorable profession. If it were would the US be in the predicament that were are in today?

    You guys are the same people who complain about the RIAA and MPAA suing college kids for downloading... and the same people who complain about American companies suing Apple for patient infringement YET it's blasphemy for a foreign country to try and uphold patients Why because they aren’t American?
